1. Scope
These terms apply to the use of the TagFix app (Android and iOS) of Rillich GmbH, Nobelring 56, 04420 Markranstädt, Germany ("we"). By using the app you agree to them.
2. What TagFix is
TagFix is an app for documenting construction sites: site diary, defect list (punch list or snag list), handover protocols and PDF reports. The app works without an account and stores your data on your device. We run no server that stores your projects.
3. Free plan and paid plans
- Free: one active project with a limited number of defects and diary entries. The app shows the current limits.
- Project Pass: a one-time purchase that removes the limits for one project. You can assign it to another project; the previous project then falls back to the rules of the free plan.
- TagFix Pro: a subscription, monthly or yearly, for any number of projects.
Limits apply only when you create new data. Viewing existing data, creating and sharing PDF reports, and ZIP backup and restore stay free in every plan and after a subscription has ended.
4. Purchases, subscriptions and cancellation
You make purchases through Apple's App Store or Google Play. The store shows you the price before the purchase, handles the payment and issues the receipt. The terms of that store apply to payment, renewal, cancellation, withdrawal and refunds.
A subscription renews automatically for the chosen period unless you cancel it in your store's subscription settings in time before it ends. A free trial turns into the paid subscription when it ends, unless you cancel it before.
After a subscription ends, your data stays on your device, readable and exportable.
5. Your data and backups
Your data is on your device only. If the device is lost or damaged, or if you delete the app, we cannot restore your data. You are responsible for making backups regularly and keeping them safe. The app's ZIP backup is not encrypted.
The privacy policy describes how the app and the website handle personal data.
6. No legal advice
TagFix is a tool for documentation. Templates, wordings and hints in the app are not legal advice and do not replace it. You are responsible for the content of your entries, reports and protocols, and for whether your records meet the requirements of your contracts and of the rules that apply to you.
7. Rights of use
We grant you the non-exclusive, non-transferable right to use the app on your devices for your own purposes, including commercial ones. You may not copy, modify, reverse-engineer or pass on the app, except where the law expressly allows it. The open-source components it contains are subject to their own licenses, which you find in the app's settings.
8. Availability and changes
We keep developing the app and may change features where that is reasonable for you. The weather lookup depends on third-party services, and we do not vouch for their availability or accuracy; you can enter or change the values by hand at any time.
9. Liability
Our liability is unlimited for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
For slight negligence we are liable only for the breach of essential contractual duties, which are duties whose fulfillment makes the use of the app possible in the first place and on which you may rely. In that case our liability is limited to the foreseeable damage typical for this kind of contract.
For the loss of data, our liability for slight negligence is limited to the effort that would also have arisen with regular backups.
10. Final provisions
German law applies. If you are a consumer, the mandatory consumer protection rules of the country where you habitually live remain unaffected.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If one provision of these terms is invalid, the others remain in force.
